Oversoul Inc., and its subsidiaries and affiliates (“Oversoul”, “we” or “us”) operates the Transcend website located at www.treeburial.org and related websites and desktop, mobile and other applications (the “Website”) and provides product and services under the Transcend™ brand.
We respect the privacy of our users and are committed to protecting it through our compliance with this privacy policy. This privacy policy describes the types of information we may collect from you or that you may provide when you access or use the Website or any of our other products or services (the Website and any of our other products or services, collectively, referred to as the “Services”) and our practices for collecting, using, maintaining, protecting and disclosing that information.
This privacy policy applies to information we collect (i) on or through your use of the Services; (ii) in email and other electronic messages between you and Oversoul; and (iii) through any mobile and desktop applications you use in connection with the Services.

Information We Collect About You

This helps us measure how the Services are performing and improve the Services for you on your particular device.

We will not store or track your device location on an on-going basis or without your permission. We do not share precise geolocation data with third parties, other than our service providers as necessary to provide the Services.

Oversoul does not control these third parties’ tracking technologies or how they may be used. How We Use Your Information
We use information that we collect about you or that you provide to us, including any Personal Information, to:

- Facilitate passing through contributions to our RNP(s).
- Fulfill any other purpose for which you provide it.
- Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including, if applicable, for billing and collection.
- Notify you when updates to the Services are available, and about changes to any products or services we offer or provide through the Services.
- Contact you about our own goods and services that may be of interest to you.
- Improve the Services through research, surveying, and engaging with you, for example, by sending you communications for these purposes.

- Debug and repair errors in our Services in order to maintain and improve the quality and security of our Services.

Disclosure of Your Information
Oversoul is not in the business of selling your Personal Information to advertisers or third parties. We consider this information to be a vital part of our relationship with you. We only share this information as described below:
- To our subsidiaries and affiliates.
- To our RNP(s) for the purpose of facilitating your contribution.
- To contractors, service providers and other third parties we use to support our business and who are bound by contractual obligations to keep Personal Information confidential and use it only for the purposes for which we disclose it to them.
- To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which Personal Information held by us is among the assets transferred.
- To third parties to market their products or services to you if you have consented to or not opted out of these disclosures. We contractually require these third parties to keep Personal Information confidential and use it only for the purposes for which we disclose it to them.
- To fulfill the purpose for which you provide it.
- For any other purpose disclosed by us when you provide the information.
- With your consent.
- To comply with any court order, law or legal process, including to respond to any government or regulatory request.

Oversoul disclaims all liability for the disclosure of information that you choose to submit voluntarily. You assume all such risks with regards to your use of the Services.
Sharing of Your Information with RNP(s)
Oversoul Inc. currently partners with a reforestation non-profit (“Reforestation Non-Profit Partner” or “RNP”) for the purpose of tree planting. Should you choose to unlock access to our Transcend Tree Burial for People benefits, your contribution will be paid to Oversoul Inc, or one of its affiliates and we will then pass your contribution directly to our RNP(s). In order to facilitate the direct pass through of contributions to an RNP, we may share your information, including your Personal Information with the RNP. This information may include your name, mailing address and email address. Once we share this information with the RNP, we have no control over the RNP’s use, disclosure or safeguarding of your information. We advise you to review the privacy policies of our RNP(s) and to contact them directly for any questions about their privacy practices or their use of your information.
By making a contribution, you consent to our transfer of your information to an RNP and you acknowledge and agree that our privacy policy does not apply to information in the custody of an RNP. If you do not consent to a transfer of your information to an RNP, you should not make a contribution.
Your Choices About Our Use and Disclosure of Your Information
We strive to provide you with choices regarding the Personal Information you provide to us. This section describes mechanisms we provide for you to control certain uses and disclosures of your information.
- Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies or block the use of other tracking technologies, some parts of the Services may then be inaccessible or not function properly.
- Promotional Offers. You may “opt-out” of receiving newsletters, marketing and promotional emails from Oversoul at any time by using the opt-out mechanism that is contained in each such email and by any other mechanisms that the Services may provide. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
How We Store, Transfer and Retain and Your Personal Information
Oversoul is a U.S. based company. Regardless of where you use our Services or provide information to us, the information may be transferred to and maintained on servers located inside and outside the U.S., including to countries outside the European Economic Area (“EEA”). By using our Services you acknowledge, agree and consent to your information, including your Personal Information, being processed outside your jurisdiction, including in countries and jurisdictions that may not provide the same level of protection. Such transfers will only take place for the specific purposes mentioned in this Privacy Policy.
Oversoul retains your Personal Information only for as long as is necessary for the purposes set out in this Privacy Policy. You can ask us to delete your Personal Information at any time by contacting us. We will delete all Personal Information associated with you within two weeks of receiving your request.

We have implemented measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration and disclosure. We cannot, however, ensure or warrant the security of any information you transmit to Oversoul or guarantee that your information on the Services may not be accessed, disclosed, altered, or destroyed by a breach of any of our physical, managerial, or technical safeguards.

Children’s Privacy
The Services are not intended for children under 13 years of age, and we do not knowingly collect Personal Information from children under 13. If we learn we have collected or received Personal Information from a child under 18 without verification of adult consent, we will delete that information.
